it out. the 59-year-old man died. a kron-4 crew is on the way to the scene -- we will bring you more details as we get them tonight. now at five - a police chase in san francisco ended with two people being killed. the suspect is behind bars. to people ended up in the hospital. it also two people ended up a hospital-- you're looking at surveillance video. police say a man ran other driver off the road - and into a liquor store. the suspect also hit a pedestrian. kron4 has team coverage. maureen kelly talked to the man whose store was hit. but first - alecia reid is live near 21st street and van ness - with more on the investigation. >> reporter: there are two people dead and there is another person in a hospital with life-threatening injuries. the man responsible is also in a hospital but he is expected to be okay. >> the guy was stopped did not want to be caused and

took off. because he tried to get away he crashed into this car and it cost two lives. >> reporter: the driver of this black car with shots fired near valencia gardens. as the officers approached the vehicle he sped off. this killed two people. it severely injured when more. >> this vehicle took off at a high rate of speed. colliding with that white vehicle through that intersection. it stopped at that liquor store. >> reporter: the female passenger died immediately and the driver of the other car was rushed to the hospital. all of the victims are in their 20s. they are familiar with the suspect and the gang task force is involved in the investigation. >> he is responsible for the

debt of two people, and the third is a life-threatening situation. >> reporter: kron4's maureen kelly spoke to the owner of this liquor store who says this was a close call for his employee who was inside at the time of the crash. >> reporter: here you can see pictures of the victim carsmashing into the front of the liquor storecaught on survailance victim car as it smashs into the front of the liquor store.the impact of the crash.broke the front door off it's hinges. the owner of the storesays his employee had been standing near the crash site only moments before it happened. that employeewilson escotowho you see here in this video was unhurt but did not want to speak to reporters. >> he is fine i told him to go get a lottery ticket because he is lucky. >> reporter: the store's owner say the driver of the victim car before he man was taken out and transported by ambulance to sf general with

delays the automatic spending cuts. for at least two months but republicans to not think that is good enough. they could vote this down or try to change it by adding $300 billion in spending cuts. >> they failed to meet the obligation. it was supposed to bring a balanced bill. and also it had spending cuts and this o official this-bills miserably. >> reporter: they are still going to try to vote on the actual a senate bill or the one that could be amended. we should know by tonight they plan on voting tonight. before the stock market opens tomorrow. more on the fiscal cliff update with michael yaki at 5:30. a peculiar standoff in san jose - a naked man holding police at bay with a samurai sword. that man - charles bennet - is now in custody - but not

high overhead in these pictures from sky 7 hd abc 7 news, the suspect, after refusing to drop the sword, decides to make a run for it. as he tried to dodge what police described as 'non lethal' projectiles, the suspect, can be seen, sword in hand, jumping a fence, eventually stabbing the blade into the ground before surrendering on the sidewalk along bascom avenue. >> initially what we were looking at based on the initial contact was that there could have been some mental illness. or possibly drugs. >> reporter: the drama began around 8 30 new year's day, a few miles away near cass and easy street where neighbors tell police the suspect was brandishing the assault weapon and then trailed here to a light rail station on southwest expressway where he dis-robed, abandoned his truck with assault weapon inside, and then stood for hours, sword in hand, refusing to cooperate with police. >> wheat called an hour crisis intervention team.

it-we called hour crisis intervention team. that specializes in mental illness. and the subject did not want to release the sword. waving it in somewhat of a threatening manner. >> reporter: after being treated with what police said were multiple, though mostly minor injuries, the suspect was booked for brandishing a sword and illegal possession of an ' an assault rifle. in san jose rob fladeboe kron 4 news san francisco police say three people were shot along the embarcadero last night during new year's celebrations. the victims are all expected to be ok. kron 4's j.r. stone has the story. >> reporter: a busy night at pier 23. people had gunshot wounds. the first at jefferson near fisherman's wharf. this is video or this man was shot in the hand. and the description of that shooting are vague. and also

today marks the four year anniversary of the shooting of oscar grant. he was the unarmed bart passenger shot and killed by police. it happened at the fruitvale bart station in 2009. this is video from a cell phone - from just before the shooting. today oscar grant's family and about a hundred supporters held a vigil at the station. >> it means to us the opportunity for us to bring back to life oscar's spirit, the spirit that lives in all of us to reunite, to never let us forget what happened on that

platform january 1st two thousand and nine. grant's family says it will continue to protest what it says is police brutality. johanas mehserle is the former bart officer who shot grant. he says he had been reaching for his taser. mehserle was convicted of involuntary manslaughter and is trying to have the conviction overturned. our team coverage continues tonight on the bart shooting anniversary - with kron4's vicki liviakis. she has more on a film being made about it -- which will soon premiere at sundance. >> reporter: the name oscar grant isn't exactly a household name. but the young man shot and killed by bart police on new year's day in 2009 will be larger than life. on the big screen. he's the subject of a feature film about to be released called "fruitvale" - where on this train platform - grant lost his life. and supporters - who don't want the public to forget - are holding a vigil.

only see on kron4 quite a shock for one bay area man who bought a car off craigslist. it turns out his shiny new ride. had actually been stolen from someone else. but the victim says he caught the criminal on camera. kron4's scott rates has more. >> i cannot believe that i fell for it. >> reporter: he is holding the title but it was supposed to be his daughter's new car. >> i have the papers, the car fax. >> reporter: patrick thought he did everything right. after finding a parked car he agreed to meet the person at a nearby shopping mall. after meeting, they paid in cash and patrick however was able to snap this photograph. right of for this man left with over $39,000. >> today, when i went to aaa. the $13,000 card -- was

>> catherine: tonight at six.a police chase ends in a deadly crash. two people were killed this morning after a driver crashed into a liquor store in san francisco. a third person was badly injured. we'll hear from people who live in the area. but first - kron4's alecia alecia? >> reporter: police thought that the vehicle that fit the description however, add briefly in the vehicle collided with another vehicle. >> this vehicle was thrown against a store. a male pedestrian was also walked into the store pronounced dead. >> reporter: this was the car that was hit. this critically injured the driver and he is in the hospital with a life- threatening injuries. he is

so far none of the victims or the suspect have been identified. the search for a man swept out to sea off point reyes has ended. the man has been found dead. this is video from sky 7 h- d, abc news. rescuers were called in after a man, woman and dog were swept to sea. live at point reyes with the latest. charles? >> reporter: this happened to near point reyes are round fall:a 30. there were walking along the beach walking their dog. this was described as a meter tragedy with a search and rescue. there was a body that was found he is being described as a 59 year-old man but so

thinners after discovering a blood clot in the vein between the brain and skull behind the right ear. they expect her to make a full recovery and say she did not suffer stroke or neurological damage. dr. jack ansell is not involved in secretary clinton's case, but has treated cases like hers and calls them rare. he is the chairman of the department of medicine at lenox hill hospital. >> reporter: what does this mean for the future? >> i think her future is as good as her past. she should recover from this, she will be treated with blood thinners. i can't say how long because i don't know all of the circumstances, but certainly a minimum of three to six months, may well be longer. in some rare cases it could be life long, but many patients are on blood thinners for life for other conditions. she should recover fully and get back to work. >> reporter: and that work is grueling, hillary clinton has traveled to more than one hundred countries as secretary of state and logged close to a million miles during that time. dr. ansell says that while travel is something to watch out for among people who

suffer blood clots, most often in the leg veins, which mrs. clinton did have in the late 1990s, he doesn't see her travel schedule being an impediment. i think the travel is probably more an issue with the blood clot she had back about twelve years ago in her leg, and so anybody who has had a blood clot, they're always at risk for developing another one, and the risk is probably a little greater than if they never had a blood clot. so, i think travel is potentially an issue for the secretary, but i would imagine that when she travels she's not sitting in a coach seat cramped up and sitting still. >> reporter: secretary clinton is planning to step down as president obama's second term begins. while she has repeatedly said she is not interested in running for president again, she is viewed as the democratic favored in 2016 should she choose to run. >> catherine: that was mary snow reporting. there are also questins about when clinton will be able to testify on
